Staff Transfers – TUPE Regulations

In outsourcing contracts the staff will almost without exception become subject to the provisions of the Transfer of Undertakings (Protection of Employment) Regulations 2006, commonly known as TUPE regulation. In essence TUPE ensures that the rights of the employee are protected during a business transfer and that the conditions of employment are maintained. Pavilion has vast experience in area of employment law having been involved in the transfer of 50 people under the terms of these regulations.

On April 6 2006 the TUPE regulations were updated with a number of changes to the 1981 regulations. Those seeking to outsource services should ensure they made themselves familiar with the law and sought the appropriate advice.
